R-78-39 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION OF THE CITY OF LAKE ELMO APPROVING <br />PLANS FOR INTERSTATE HIGHWAY 94 (SO-CALLED <br />"SOUTHERN ROUTE") SUBJECT TO CERTAIN CONDITIONS <br />AND ACCEPTING OF OWNERSHIP AND MAINTENANCE <br />RESPONSIBILITY FOR FRONTAGE ROADS AND BICYCLE <br />TRAILS. <br />WHEREAS, the Commissioner of the Department of Transportation <br />has prepared plans for the improvement of part of Trunk Highway <br />No. 392, renumbered as Trunk Highway No. 94, within the corporate <br />limits of the City of Lake Elmo from the junction TH 494/694 to <br />the east corporate limits of the City of Lake Elmo; and <br />WHEREAS, said plans are on file in the Office of the <br />Department of Transportation, St. Paul, Minnesota, being marked, <br />labeled and identified as "Layout and Profile Nos. 27 and 27A <br />S. P. 8282-40 (94 equal 392) from junction TH 494/694 to the <br />St. Croix River"; and <br />WHEREAS, copies of the said plans so marked, labeled and <br />identified are also on file in the office of the City Clerk; and <br />WHEREAS, the term "said plans" as hereinafter used in the <br />body of this Resolution shall be deemed and intended to mean, <br />refer -to and to incorporate the plans as they are described in <br />the foregoing recitals: <br />NOW, THEREFORE, BE IT RESOLVED, that the said plans for the <br />improvement of Trunk Highway No. 392, renumbered Trunk Highway No. <br />94, within the City limits of the City of Lake Elmo be, and they <br />hereby are, approved with the following reservations and conditions: <br />(1) The City of Lake Elmo hereby reserves the <br />right to challenge the decision of the <br />Department of Transportation in relocating <br />said Highway from the planned "northern <br />route" to the planned "southern route" <br />through such judicial action as has been or <br />will, hereafter, be taken by the I-94 Challenge <br />Committee under the joint powers agreement to <br />which the City of Lake Elmo is a party. <br />
