RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING CONCEPT PLAN FOR SPRINGBORNS GREEN ACRES <br />A SUBDIVISION PROPOSED UNDER THE PROVISIONS OF CHAPTER 302 OF <br />THE CITY CODE PROVIDING FOR PLANNED UNIT DEVELOPMENT. <br />WHEREAS, Howard C. Springborn and Gaylen W. Springborn have applied <br />for subdivision approval of a Planned Unit Development to be located on <br />the land described in Exhibit "A" annexed hereto and made a part hereof; and <br />WHEREAS, the proposed plan, now on file with the City Clerk, has <br />been reviewed by the City staff and considered a public hearing by the <br />City Planning Commission all as required by City ordinances; and <br />WHEREAS, the City Council has also considered the proposed Planned <br />Unit Development and subdivision together with the recommendations of <br />the Planning Commission thereon and the recommendations of the City <br />staff; and <br />WHEREAS, the City Council has determined: <br />1. That the proposed Planned Unit Development Concept Plan is not, <br />in any way, inconsistent with the public health, safety and general <br />welfare. <br />2. That the proposed Concept Plan is consistent with the intent and <br />purpose of the City's Comprehensive Plan, zoning ordinance, subdivision <br />ordinance and other applicable regulations; provided the conditions of <br />approval set forth below are incorporated into said plan: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council that the Concept <br />Plan for SPRINGBORN'S GREEN ACRES on file with the City Clerk is hereby <br />approved subject to the following conditions: <br />1. The Concept Plan is approved for 31 lots having a gross density <br />of 2.02 acres per lot for an average lot size of 1.79 acres, all as shown <br />on the plan filed with the City Clerk, as amended. It is the intent of <br />the City Council in approving 31 lots of such size to permit only the <br />same number of lots as would have been permitted under the existing <br />zoning but, at the same time, to permit the Developers to average the <br />density between that part of their land zoned for one acre lot size <br />(25.26 acres) and that part of their land zoned for five acre lot size <br />(30.17 acres). <br />
