R78-49 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION DENYING THE APPLICATION FOR A SPECIAL USE PERMIT <br />BY THE LOYAL ORDER OF MOOSE, ST. PAUL LODGE 040 <br />WHEREAS, the Loyal Order of Moose, St. Paul Lodge <br />#40 applied on August 1, 1978 for a Special Use Permit pursuant <br />to 5.03 Lake Elmo City Ordinances for construction of a Moose <br />Lodge, and <br />WHEREAS, this Lodge would be constructed on the follow- <br />ing described real property, to -wit: <br />The Westerly Three Hundred (300) feet of the South- <br />erly Six Hundred and Fifty (650) feet of the West <br />Half (W 1/2) of the Southwest Quarter (SW 1/4) of <br />Section Twenty-eight (28) Township Twenty-nine North <br />(29N), Range Twenty-one West (21W). <br />which is presently zoned in the Single Family Urban District, <br />and <br />WHEREAS, Lake Elmo Ordinances 7.03 permits, upon <br />the meeting of certain requirements as a special use in a Single <br />Family Urban District, a "club or lodge", and <br />WHEREAS, Lake Elmo Ordinances 3.02(T) defines a "club <br />or lodge" as: A club or lodge is a non-profit association of <br />persons who are bona fide members paying annual dues, use of prem- <br />ises being restricted to members and their guests. It shall be <br />permissible to serve food and meals on such premises providing <br />adequate dining room space and kitchen facilities are available. <br />Serving of alcoholic beverages to members and their guests shall <br />be allowed, providing such serving is secondary and incidental <br />to the operation of the dining room for the purpose of serving <br />food and meals and providing further that such serving of alcoholic <br />beverages is in compliance with the applicable federal, state <br />and municipal .laws, and <br />WHEREAS, a Public Hearing was held by the Planning and <br />Zoning Commission on September 11, 1978 and the Council has dis- <br />cussed the proposed use with members of the applicant organization <br />and it appears that the lodge intends to operate a bar and serve <br />alchoholic beverages to its members and their guests seven days <br />a week from 4:30 p.m. to 1:00 a.fn. The club has a membership of. <br />375 men and 200 women and sponsers a Saturday evening dance each <br />week. There will be parking for 132 vehicles, and <br />
