WHEREAS, in order for the Council to grant such appli- <br />cation, it must determine pursuant to 5.03 (B) that: The proposed <br />use will not be detrimental to the health, safety, morals or <br />general welfare of the community nor will cause serious traffic <br />congestion nor hazards, nor will seriously depreciate surrounding <br />property values and that said use is in harmony with the general <br />purpose and intent of this ordinance and the Comprehensive Plan.., <br />NOW THEREFORE, BE IT RESOLVED, by the City Council of <br />the City of Lake Elmo as follows: <br />That the City Council denies said application for the. <br />following reason: <br />The applicant fails to meet the criteria for classifi- <br />cation as a "club or lodge" and that the proposed Moose Lodge <br />intends to serve alcoholic beverages to its members and guests <br />at a bar in its proposed structure. This serving would not be <br />"secondary and incidental to the operation of the dining room <br />for the purposes of serving food and meals". The Council is, <br />therefore, without legal authority to grant such use in a Single <br />Family Urban District. <br />Adopted by the City Council this 21st. day of <br />November, 1978. <br />Thomas G.
