R-78-24 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION GRANTING SPECIAL :USE -PERMIT -TO MR. AND MRS. SOL FISHER. WHEREAS, Mr. and Mrs. Sol Fisher of 8139-38th. St. N. has requested a Special Use Permit for a private hobby dog kennel; and WHEREAS, The Planning Commission, after receiving re- leases from all property owners within 350 feet said appli- cation, as required by City ordinance, has recommended unan- imously that the Special Permit be granted subject to .renewal on a year -ago -year basis; and WHEREAS, the applicant appeared before the City Council July 18, 1978 at which time the City Council considered the application and the recommendation of the Planning Commission; and WHEREAS, the City Council has determined that the use proposed by the applicant will not be detrimental to the health, safety, morals or general welfare of the community, nor will it cause serious traffic congestion or hazards, nor will it seriously depreciate the surrounding property values, provided such use is limited and restricted as hereinafter set forth. That the said use, is limited and restricted as herein- after set forth, is in harmony with the general purposes and intent of the City zoning ordinance and the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED, that the applicant, Mr. and Mrs. Sol Fisher, is hereby granted a Special Use Permit for a private hobby dog kennel at 8139-38th. St. N., Lake Elmo, Minnesota, subject to the following conditions, limitations and restrictions: 1. No boarding of dogs shall be permitted at said kennel at any time. 2. All dogs kept at said kennel shall be kept in accor- dance with the provisions of Section 1402 of the City Code. Specifically, meaning of said Section 1402 4. Any violation of the provisions of the Special Use Permit or other ordinance of the City relating to the keeping of dogs or prohibiting nuisances shall be grounds for revocation of this permit after a hearing on two weeks notice to applicant.
