RODERICK A. LAWSON
DONALD T. RALEIGH
RAYMOND O. MARSHALL
LAWSON, RALEIGH 8. MARSHALL, P.A.
LAWYERS
3625 LAKE ELMO AVENUE NORTH
LAKE ELMO, MINNESOTA 5SO42
(612) 777-6960
November 10, 1978
Mr. Laurence Whittaker
Administrative Assistant
11194 Upper 33rd Street North
Lake Elmo, Minnesota 55042
REUBEN G. THOREEN 1912-1967
MILTON LINDBLOOM 1925-1936
CHESTER S.WILSON 1915-1977
Re: Recodification and Revision of Subdivision and Zoning Ordinance
Dear Larry:
The purpose of this letter, is to confirm my understanding that
we will proceed with recodification of the existing City Code to
include amendments which have been passed since 1974 as well as the
technical corrections made necessary by State Law Amendments, obvious
errors in 74 Code, and other such matters.
We will include in the recodification the new subdivision ordinance
which has been approved by the Citv Council.
In this way, we will avoid the cost of publishing the subdivision
ordinance in a newspaper. You will recall our discussion relating to
"publishing". Within the meaning of the statute City ordinances may be'
11published" in two ways. They may be published by printing in the official
newspaper or they may be published by being printed in book or
pamphlet form in sufficient quantities to be generally available to the
public. In the latter case, only a notice of availability need be published
in the official newspaper. I assume that would cost at least $1,500.00
which should be less than the cost of printing and distributing a new
code including the new subdivision ord inance .
In printing the new code and subdivision ordinance, we will pring
the zoning ordinance as it exists on this date, then, when the new
zoning ordinance is completed - presumably within the next three or
four months - we can simply prepare and distribute a new code including
the new zoning ordinance. The cost of printing and distributing a new
code including the new zoning ordinance would probably be substantially
less than publishing the new zoning ordinance in the official newspaper.
Yours u y,
Donald T. Raleigh
DTR : ms
