R79-13 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A SPECIAL USE <br />PERMIT TO CONSTRUCT AND MAINTAIN A <br />REAL ESTATE IDENTIFICATION SIGN IN <br />DEMONTREVILLE HIGHLANDS, 6TH ADDITION <br />WHEREAS, the Derrick Land Company has requested a <br />Special Use Permit .for a real estate identification sign; <br />and, <br />WHEREAS, the Planning Commission, after notifying all <br />property owners within 350 feet of the proposed site, hold- <br />ing a public hearing January 2.2, 1979; and recommending that <br />a Special Use Permit be granted subject to the following con- <br />ditions: (1). Sign remains not over two (2) years, (2).Limit <br />the size of the sign to 81x241, (3). Meet the requirements <br />of the Model Zoning, on Pg. 99, paragraph g and Pg. 140, <br />paragraph Q. <br />WHEREAS, the applicant appeared before the City Council <br />February 6, 1979, at which time the City Council. considered <br />the application and the recommendati.on.•of the Planning Com- <br />mission; and, <br />WHEREAS, the City Council has determined that the use <br />proposed by the applicant will not be detrimental to the <br />health, safety, morals or general welfare of the community, <br />nor will it cause serious traffic congestion or hazards, nor <br />will it seriously depreciate the surrounding property values <br />provided such use is limited and .restricted as hereinafter <br />set forth. <br />That said use, if. .limited and restricted as hereinafter <br />set forth, is in harmony with the general purposes and intent <br />of the City :Zoning Ordinance and the Comprehensive Plan. <br />NOW, THEREFORE, BE IT RESOLVED, that the applicant, <br />Derrick Land Company, is hereby granted a Special Use Permit <br />for a real estate identification sign in Demontreville High- <br />lands, 6th. Addition, subject to the following conditions: <br />1. The sign be no larger than 8'x241; <br />2.. It be a non -illuminated sign; <br />3. It be removed at the end of two years; and if <br />not removed by the owner, be removed by the City <br />and charged back to the owner; and, <br />4. That it meet all. the other conditions of. the <br />Zoning Ordinance relating to signs; <br />5. Said permit shall not be effective until the same <br />has been endorsed by the applicant and approved <br />by the City Attorney and the original thereof <br />filed with the City Administrator. <br />
