R-eo.-32 A <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASIIINGTON COUNTY, MINNESOTA <br />A RESOLUTION ACCEPTING TIIE IMPROVEMENTS IN THE <br />PLAT OF SPRINGBORN'S GREEN ACRES <br />WHEREAS, the developers of Springborn's Green Acres <br />Subdivision have completed the improvements required under <br />the Development Agreement between the City and said developers, <br />dated January 8, 1.979; and <br />WHEREAS, street improvements were accepted November 20, <br />1979, and all. other improvements have been inspected by <br />the City Engineer and said City ]Engineer, by his letter of <br />May 30, 1980, has .recommended acceptance of the improvements <br />and; <br />WHEREAS, Section 401..510D of t:he Subdivision Ordinance <br />provides that the subdivider shall warranty said improvements <br />for one year after their acceptance; <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of <br />the City of Lake :Elmo as follows: <br />1. The turf restoration improvements of boulevards and <br />other disturbed areas constructed by the developer of the plat <br />of Springborn's Green Acres be, and the same hereby are, <br />accepted by the City Council. subject to the right of the City <br />to require the developer to perform any remaining corrective <br />work which may appear to be necessary to the City Engineer <br />before June 3, 1981. <br />2. The remaining street improvements and storm sewer <br />improvements constructed by the developer of the plat of <br />Springborn's Green Acres be, and the same hereby are, accepted <br />by the City Council for maintenance subject to the right of <br />the City to require the developer to perform any remaining <br />corrective work which may appear to be necessary to the City <br />Engineer before November 20, 1.980. <br />3. The City acknowledges the installation of certain <br />utility improvements by the developer and various public <br />utilities in the plat of Springborn's Green Acres; however, <br />the City accepts no responsibility whatsoever for maintenance <br />of these utility improvements. <br />
