R-eo.-32 A RESOLUTION CITY OF LAKE ELMO WASIIINGTON COUNTY, MINNESOTA A RESOLUTION ACCEPTING TIIE IMPROVEMENTS IN THE PLAT OF SPRINGBORN'S GREEN ACRES WHEREAS, the developers of Springborn's Green Acres Subdivision have completed the improvements required under the Development Agreement between the City and said developers, dated January 8, 1.979; and WHEREAS, street improvements were accepted November 20, 1979, and all. other improvements have been inspected by the City Engineer and said City ]Engineer, by his letter of May 30, 1980, has .recommended acceptance of the improvements and; WHEREAS, Section 401..510D of t:he Subdivision Ordinance provides that the subdivider shall warranty said improvements for one year after their acceptance; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake :Elmo as follows: 1. The turf restoration improvements of boulevards and other disturbed areas constructed by the developer of the plat of Springborn's Green Acres be, and the same hereby are, accepted by the City Council. subject to the right of the City to require the developer to perform any remaining corrective work which may appear to be necessary to the City Engineer before June 3, 1981. 2. The remaining street improvements and storm sewer improvements constructed by the developer of the plat of Springborn's Green Acres be, and the same hereby are, accepted by the City Council for maintenance subject to the right of the City to require the developer to perform any remaining corrective work which may appear to be necessary to the City Engineer before November 20, 1.980. 3. The City acknowledges the installation of certain utility improvements by the developer and various public utilities in the plat of Springborn's Green Acres; however, the City accepts no responsibility whatsoever for maintenance of these utility improvements.
