R-80-56 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AUTHORIZING CERTAIN IMPROVEMENTS OF PRIVATE, <br />PROPERTY ADJACENT TO LEGION POND IN THE CITY OF LAKE ELMO <br />WHEREAS, the City Council has reviewed the Petition from <br />Thomas Deck, William Petersen, and Rodney Toft to fill their <br />lots and do all work necessary to make their Septic Systems <br />workable and to bring those systems up to city standards; <br />and, <br />WHEREAS, the City Council is aware of the problem of fail- <br />ed Septic Systems of private homes adjacent to Legion Pond; <br />and, <br />WHEREAS, the land owners adjacent to Legion Pond have re- <br />quested the Council to order the improvements of the private <br />Septic Systems so as to enable the .improvement to be a cost <br />of the city and assessable against the benefited property; <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the <br />City of Lake Elmo, as follows: <br />1. The city hereby authorizes the improve- <br />ment of the Septic Systems on lots 8, 9 <br />and 10, Myron Elman Subdivision in said <br />city. <br />2.. The City Engineer shall begin all studies <br />necessitated by said improvement and <br />shall take bids to implement said filling <br />project. Depending upon the amount of <br />suitable fill available at the City of <br />Lake Elmo Landfill .it is understood that <br />one-fourth of the amount will be allocated <br />to Mr. Dan Collyard with the remaining fill <br />to be distributed equally among Mr. Thomas <br />Deck, Mr. William Petersen and Mr. Rodney <br />Toft. Any additional fill will be'purchased <br />if the city fill is inadequate or if a less <br />expensive source is available. <br />
