RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION ACCEPTING THE STREET AND STORM SEWER <br />IMPROVEMENTS FOR DEMONTREVILLE HIGHLANDS 5TH ADDITION <br />AND DEMONTREVILLE HIGHLANDS GTH ADDITION AND REDUCING <br />THE BOND TO $5,000.00 PRIOR TO FINAL CLEANUP. <br />WHEREAS, the developers of Demontreville Highlands <br />5th. Addition and Demontreville Highlands Gth. Addition have. <br />completed the street improvements and storm sewer improvements <br />required under the Development Agreements between the City and <br />said developer; and <br />WHEREAS, said street improvements and storm sewer improve- <br />ments have been inspected by the City Engineer and said City <br />Engineer has recommended acceptance of these improvements; and <br />WHEREAS, the City Engineer has reported to the City <br />Council that some ditching and cleanup work of a pond remain <br />to becompleted, but that the developer and the City Engineer <br />feel this final work cannot be done until the Spring of 1981; and <br />WHEREAS, the City Engineer has recommended the City retain <br />a bond of $5,000.00 to assure completion of the ditching and <br />pond cleanup; and <br />WHEREAS, Section 401.510 D of the Subdivision Ordinance <br />provides the subdivider shall warrant the said improvements <br />for one (1) year after their acceptance; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Lake Elmo as follows: <br />1. The street improvements and storm sewer improvements <br />constructed by the developer of the plat of Demontreville <br />Highlands 5th. Addition and Demontreville Highlands 6th. Addition <br />be, and the. same hereby are, accepted by the City Council for <br />maintenance subject to the right of the City to require the <br />developer to perform anycorrectivework which may appear to <br />
