LAKE ELMO CITY COUNCIL MEETING, APRIL 79 1981 <br />Q <br />F, J. CROMBIE ESTATES - FINAL PLAT: The Counoil reviewed the PW recommendation to <br />approve the final plat, Bruce Folz said that the park donation amount, as <br />determined by the Park Commission, is agreeable to Mrs. Crombie, Folz reviwed <br />the sample deed tying the outlets to the lots and said a title opinion has been <br />completed for the property. <br />Morgan moved, seconded by Mottaz, to d.dopt R-81-2 , a Resolution approving the <br />plat for P. J. Crombie Estates, subject to review of the City Attorney, and accepting <br />the park donation in the amount of $693.88. Motion carried 5-0. <br />OLD 'BUSINESS: <br />A. Surface Water Use Ordinance - The Council reviewed DNR's response to this <br />Or.dinancep and discussed the following changes: <br />1, retaining the 'no wake' area rather than the 15 mph speed proposed by DNR; <br />2. the channel between Lake DeMontreville and Olson Lakes be designated a 'no <br />wake' erosion, zone; and, <br />3, the definition of motorboat be deleted; <br />Because part of Horseshoe Lake is in West Lakeland, the City will send a copy of <br />the Surface Water Ordinance to them and ask that they adopt it. This would permit <br />the City to enforce the Ordinance on a shared body of water. <br />The Administrator will make the necessary changes and bring the revised Ordinance <br />back for Council approval. <br />B. SurveyOrdinance - The Council reviewed an ordinance that would require <br />a survey to identify lot lines and locate now structures on a lot. <br />Eder moved, seconded by Morgan, to adopt Ordinance 79259 an Ordinance amending <br />Section 502,140, of the 1979 Municipal Code, authorizing the Building Inspector to <br />require a Certificate of Survey, if he deems it necessary, before issuing a building <br />permit. Motion carried 5-0. <br />C. Agreement with Valley Branch on lbDloyees The Council reviewed the Administrator's <br />outline of the current City policy on. handling employee <br />and the City - employees who perform work for the Watershed. The Council <br />discussed a 15/ service charge to cover -the administrative work in handling <br />the payroll for Dick Murray, a Valley Branch employee. The District pays a 15% <br />overhead fee when City employees are used for. Valley Branch work. <br />Morgan moved, seconded. by Mottaz, to adopt a 15916 administrative charge to cover <br />expenses incurred in handling payroll for Valley Branch employees and City 1hployees <br />engaged for. Watershed work; and the memorandum setting out the relationship of the <br />City to the Valley Branch Watershed District for work on Project 1005, <br />Motion carried 4-0-1. Eder abstained. <br />The Administrator will verify if the insurance, PICA, Workman's Comp, etc, are <br />being paid by Valley Branch for Dick Murray. <br />D. Appointments - <br />Mottaz moved, seconded by Morgan, to table the appointments until April 219 1981. <br />Motion carried 5-0. The Administrator will ask the Planning Commission applicants <br />to come in .for interviews at this meeting. <br />Morgan moved, seconded by Edero to extend the meeting. Motion carried 5-0. <br />
