R-81-64 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION WITHDRAWING AND DISMISSING <br />THE PETITION FOR VALLEY BRANCH WATERSHED <br />DISTRICT PROJECT 1006. <br />WHEREAS, the City of Lake Elmo, Minnesota, the <br />Town of West Lakeland, Minnesota and the County of Washington, <br />Minnesota, petitioned the Valley Branch Watershed District <br />in June, 1980, pursuant to Minnesota Statute 112.48 for an <br />improvement project, and, <br />WHEREAS, the Valley Branch Watershed District has <br />completed the studies on the proposed Project 1006 and a <br />public hearing has been held, and, <br />WHEREAS, the City of Lake Elmo, the Township of <br />West Lakeland, and the County of Washington have determined <br />that the project in its present form is not proper for the <br />following .reasons: <br />1. The project is of an oversized design beyond <br />the need for handling present problems. <br />2. The project is designed to handle water problems <br />in areas that may never be tributary to the <br />main stem. <br />3. The project provides outlets for areas where <br />there is no problem, where there is adequate <br />storage or where cheaper alternatives for out - <br />letting are available. . <br />4. The original petition did riot include outlets <br />for Downs Lake and Sunfish Lake and proposed <br />outlets for both of those two lakes are in- <br />cluded in this project. <br />5. The project proposes improvements to Tartan <br />Park when representatives from 3M, Tartan <br />Park and the 3M Club have indicated throughout <br />the process that they would make these improve - <br />merits once an outlet for Horseshoe Lake was <br />developed. <br />6,. The proposed project- distorts the intent of the <br />petitioners and the committee that helped develop <br />the parameters of the engineer's report by en- <br />larging and expanding the project far beyond the <br />need and ability of the communities to finance <br />the project, and <br />
