NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo as follows: <br />1. The application of Carl Olinger and Dan Olinger for a <br />simple lot division for the real estate described above <br />be and the same hereby is granted subject to the follow- <br />ing conditions to which the applicants agree. <br />a. The property on both sides of 45th Street shall be <br />shown as one parcel with 66 feet of right-of-way <br />for Lake Jane Trail being shown as an exception. <br />b. A legal description shall be furnished the City <br />which describes the two parcels as one parcel. <br />C. A legal description for the exception from the <br />parcel described in the preceeding paragraph <br />and a deed to the City for that parcel. <br />d. Applicants shall agree that these parcels can not <br />be separated. <br />Adopted by the City Council of the City of Lake Elmo this <br />17th day of November , 1981. <br />ATTEST: <br />Laurence E.
