a <br />R-82-1.8 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON,COUNTY, MINNESOTA <br />A RESOLUTION GRANTING THE CONDITIONAL USE PERMIT <br />TO OPERATE A GOLF COURSE IN CIMARRON PARK. <br />WHEREAS, Section 301.070 D.5,b.(5) of the 1979 Municipal <br />Code of Lake Elmo requires a Conditional Use Permit for a Golf <br />Course in a Mobile Home Park; and, <br />WHEREAS, Section 301.060 D.l.O.a. requires annual. <br />.renewal of said Conditional Use Permit; and, <br />WHEREAS, the owners of the golf course at Cimarron Park <br />have applied for a renewal of their Conditional Use Permit; and, <br />WHEREAS, the operation of the golf course has given rise <br />to complaints of certain nuisances: <br />NOW, TFIEREFORE, BE IT RESOLVED by the City Council of <br />the.City of Lake Elmo that the Conditional Use Permit for operation <br />of the 9 hole golf course at Cimarron Park, from January 1, 1982, <br />until December 31, 1982, is hereby granted, subject to the following <br />conditions; <br />1. That the owners of Cimarron Park shall, <br />demonstrate that they have taken responsible <br />action to process claims for damages from golfers <br />to residences and personal property of residents. <br />Claims to be submitted to Cimarron management <br />with a copy of each claim sent to the City. <br />Cimarron will prepare a year --end report on all <br />claims and their disposition for Council review. <br />Their performance will be a factor in determining <br />the renewal of the Conditional Use Permit. <br />2. That the owners of Cimarron Park shall comply <br />with the City's Noise Ordinance. <br />3.. That- all mowing of the golf course shall begin <br />at the perimeter of the course and end at the area <br />closed.t to the homes. <br />4.
