R-82,-46 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR <br />TO EXECUTE AN AGREEMEIIT FOR A LICENSE TO CONSTRUCT, <br />MAINTAIN AND USE A WATER1.4AIN UNDER THE CHICAGO AND <br />NORTHWESTERN TRANSPORTATION COMPANY RAILROAD RIGHT-OF- <br />WAY APPROXIMATELY 800 FEET WEST OF LAKE ELMO AVENUE. <br />WHEREAS, the City Council of the City of Lake Elmo has <br />found it necessary to provide a second watermain connection <br />between the water tower and the north side of the Chicago and <br />Northwestern right-of-way; and, <br />WHEREAS, the Chicago and Northwestern Transportation <br />owns_f-he right-of-way through, which this watermain must pass, <br />and requires a license to construct, maintain and use said <br />right-of-way for a watermain crossing; and, <br />WHEREAS, the City Council has found that the terms of <br />said license are reasonable and the license is essential to <br />completion of the project. <br />NOW, THEREFORE,'BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF LAKE ELMO, WASHINGTON COUNTY, MINNESOTA, THAT: <br />1.
