RESOLUTION CITY OF LAKE ELMO WASHINGTON,COUNTY, MINNESOTA A RESOLUTION GRANTING THE CONDITIONAL USE PERMIT TO OPERATE A GOLF COURSE IN CIMARRON PARK. WHEREAS, Section 301.070 D.5,b.(5) of the 1979 Municipal Code of Lake Elmo requires a Conditional Use Permit for a Golf Course in a Mobile Home Park; and, WHEREAS, Section 301.060 D.10.a. requires annual renewal of said Conditional Use Permit; and, WHEREAS, the owners of the golf course at Cimarron Park have applied for a renewal of their Conditional Use Permit; and, WHEREAS, the operation of the golf course has given rise to complaints of certain nuisances: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo that the Conditional Use Permit for operation of the 9 hole golf course at Cimarron Park, from January 1, 1982, until December 31, 1982, is hereby granted, subject to the following conditions: 1. That the owners of Cimarron Park shall demonstrate that they have taken responsible action to process claims for damages from golfers to residences and personal property of residents. Claims to be submitted to Cimarron management with a copy of each claim sent to the City. Cimarron will prepare a year-end report on all claims and their disposition for Council review. Their performance will be a factor in determining the renewal of the Conditional Use Permit. 2. That the owners of Cimarron Park shall comply with the City's Noise Ordinance. 3. That all mowing of the golf course shall begin at the perimeter of the course and end at the area closest to the homes. 4. That Cimarron Park owners shall provide adequate off-street parking, sewer facilities, and solid waste disposal to serve the patrons of the golf course.
