WHEREAS, Cimarron ParkR w has applied for a Conditional Use'Permit for on see attached drawing Public Golf Course at 901Lake _Elmo _AVe. Now Lake Elmo, Minn_55042 in the City of Lake Elmo from January 1, 198 through December 31, 1.98 3_; and has submitted all required information and fees for the application for such permit; and, WHEREAS, Section 301.070 D 5 b (5) _ _ _of the Municipal Code of Lake Elmo, requires a Conditional Use Permit to operate a ___Public Golf in the City of Lake Elmo; and, WHEREAS, Sections------- Zoni_nR Ordinance of the Municipal Code of Lake Elmo sets forth the conditions under which said permit may be granted and such use permitted; and, WHEREAS, the applicant meets or exceeds all the conditions set forth above; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo, THAT, the Conditional Use Permit Public Golf Course at� JQl Js m �_1yo.. Id_e Elmo. Minn. 55042 is hereby granted to� Cimarron from January 1, 198___3__ through December 31, 198_3 _, subject to the following conditions: 1.. That the owners of Cimarron Park shall demonstrate that they have taken responsible action to process claims for damages from golfers to residences and personal property of residents. Claims to be submitted to Cimarron management with a copy of each claim sent to the City. Cimarron will prepare a year-end report on all claims and their disposition for Council review. Their performance will be a factor in determining the renewal of the Conditional Use Permit.
