R83- 45 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY. MINNESOTA <br />A RESOLUTION RELATING TO PAYMENT OF THE FEE <br />UNDER THE SUBDIVISION ORDINANCE IN LIEU OF <br />PARK DONATION AND REPEALING RESOLUTION 79-37 <br />WHEREAS, the City of Lake Elmo has adopted various <br />subdivision ordinances providing for donation of park <br />land or in the alternative the payment of a fee to the <br />City; and, <br />WHEREAS, since October 3, 1968, the City of Lake <br />Elmo has by ordinance regulated minor subdivisions which <br />were exempt from the park dedication requirements; and, <br />WHEREAS, the City Council determined , in <br />Resolution 79-37 that the City would collect a fee in <br />the amount of $175.00 per lot in lieu of park land ded- <br />ication on all those minor lot subdivisions occurring <br />since October 3, 1968; <br />WHEREAS, Ordinance 7951 requires a park land or <br />cash donation for all minor subdivisions. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council <br />of the City of Lake Elmo: <br />1. Effective immediately all minor subdivisions <br />occurring from October 3, 1968 to July 5, 1983, shall <br />pay to the City a fee of $175.00 per lot, in lieu of <br />park donations, at the time a building permit is issued <br />for that lot. <br />2. All Simple and Large Lot subdivisions shall pay <br />to the City a fee of $175. per lot in lieu of park donations, <br />at the time of subdividing before recording of said sub- <br />division. <br />3. The City Administrator is authorized and directed <br />to determine what parcels are effected and to collect said <br />fee. <br />4.
