R-83-50 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A SHORELAND PERMIT AND VARIANCE <br />TO JEFFREY D. NELSON. <br />WHEREAS, Jeffrey D. Nelson who resides at 8012 Hill <br />Trail North in the City of Lake Elmo, owns certain real <br />estate in said City, legally described as follows, to -wit: <br />Lots 432 thru 437, and lots 705 thru 710 <br />and the westerly 1/2 of lot 438 and the <br />westerly 1/2 of lot 7.04 all in LANES <br />DEMONTREVILLE COUNTRY CLUB ADDITION, <br />according to the plat thereof on file and <br />of record in the office of the County <br />Recorder, Washington County, Minnesota; <br />WHEREAS, said Jeffrey D. Nelson has applied to the City <br />of Lake Elmo for permission to construct an accessory structure <br />on the above described real estate, said structure consisting <br />of a two and one-half car garage to be in the approximate size <br />of 576 square feet; and <br />WHEREAS, the City Code requires a shoreland permit together <br />with a variance from the lot size and lot width requirements <br />before the proposed construction could be approved; <br />WHEREAS, there does not appear to be any reason relating <br />to the public health, safety and welfare of why the above <br />described variance and shoreland permit should not be granted to <br />the applicant. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the <br />City of Lake Elmo as follows: <br />1. The above named applicant is hereby granted both a <br />shoreland permit and a variance from the lot size and width <br />requirement of the City Ordinance to permit the construction <br />of the accessory building described above. <br />
