DEVELOPMENT AGREEMENT <br />TARTAN MEADOWS <br />d� <br />THIS/AGREEMENT, made and entered into this day of <br />1983, by and between the City of Lake Elmo, <br />a municipal corporation organized under the laws of the State <br />of Minnesota (the "City"), and Willard Morton (the "Developer"), <br />WITNESSETH: That: <br />WHEREAS, the Developer has made application to the City <br />I <br />Council for approval of a land development within the corporate <br />limits of the City described as follows; <br />The Southeast One Quarter of the South- <br />west One Quarter (SE; of SWa) of Section. <br />Twenty-five (25), Township Twenty-nine <br />(29), Range Twenty-one (21), Washington <br />County, Minnesota (the "Development" to be <br />named "Tartan Meadows"); and <br />WHEREAS, the Developer hereby warrants and represents to <br />the City as inducement to the City's entering into this Agreement <br />that Developer's interest in the land area of the Development is <br />fee owner. <br />WHEREAS, the City Council by resolution adopted February <br />17, 1981, has granted preliminary approval to the Development, <br />on the condition that the Developer enter into this agreement <br />to provide for the installation of streets, utilities, land- <br />scaping and other improvements hereafter described on the <br />terms and conditions hereafter set forth., <br />
