A-83- o RESOLUTION CITY OF LAKE ELMO 5 0 WASHINGT'ON COUNTY, MINNESOTA �r- A RESOLUTION GRANTING A CONDITIONAL USE.PERMIT� r- TO__ Cimarron Park Limited Partnership r" FOR Public Golf Course IN THE__R3 _ZONING DISTRICT FROM JANUARY 1, 1983 through DECEMBER 31, 198 3 WHEREAS, Cimarron Park has applied for a Conditional Use Permit for Public Golf Course on, see attached drawing at� 901 Lake Elmo AVe. No. Lake E1.mo, Minn 55042 in the City of Lake Elmo from January 1, 198_.I_ through December_ 31, 198 3 and has submitted all required information and fees for the application for such permit; and, WHEREAS, Section_ 301.070 D 5 b (5) of the Municipal Code of Lake E1mo,requi.res a Conditional Use Permi.L to operate a _ Public Golf Course in the City of Lake Elmo; and, WHEREAS, Sections___ Zonin Ordinance _ _ _ of the Municipal Code of Lake Elmo sets forth the conditions under which said permit may be granted and such use permitted; arid, WHEREAS, the applicant meets or exceeds all. the conditions set forth above; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo, THAT, the Conditional Use Permit Public Golf Course at Elmo Zinn. 55042 is hereby granted to Cimarron from January 1, 198_3 through December 31, 198-3 subject to the following conditions: 1. That the owners of Cimarron Park shall demonstrate that they have taken -responsible action to process claims for damages from golfers to residences and personal property of residents. Claims to be submitted to Cimarron management with a. copy of each claim sent to the City. Cimarron will prepare a year-end report on all claims and their disposition for Council review. Their performance will be a factor in determining the renewal of the Conditional Use Permit.
