R-83- 6 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE.PERMIT <br />TO_ Cimarron Park, Limited Partnershi_D_ <br />FOR —Public Golf CourseIN THE TIIE R3 _ZONING DISTRICT FROM JANUARY 1, 1983 through <br />DECEMBER 31, 1.98 3 <br />WHEREAS, Cimarron Park <br />has applied for a Conditional Use'Permit for Public Golf Course <br />on see attached drawing �' " " �- <br />at 901 Lake Elmo AVe,. No, , Lake Elmo. Minn.55042 <br />in the City of Lake Elmo from January 1, 198 �LL through December 31, <br />198_3 _; and has submitted all required information and Fees for the <br />application for such permit; and, <br />WHEREAS, Section_ 301.070 D 5 b (5) __ _of the <br />Municipal Code of Lake E1mo,requi,res' a Conditional Use Permit to <br />operate a Public Golf Course <br />in the City of Lake Elmo; and, <br />WHEREAS, Sections <br />of the Municipal Code of. Lake Elmo setts forth the conditions under <br />which said permit- may be ranted d <br />set <br />City <br />at <br />g e an such use permitted; and, <br />WHEREAS, the applicant meets or exceeds all the conditions <br />forth above; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />of Lake Elmo, <br />THAT, the Conditional Use Permit Public Golf Course <br />----- - - 42 <br />is hereby granted to _ Cimarron <br />from January 1, 198 through December 31, 198 3 subject to <br />the following conditions: <br />1. That the owners of Cimarron Park shall demonstrate that they <br />have taken responsible action to process claims for damages <br />from golfers to residences and personal property of residents. <br />Claims to be submitted to Cimarron management with a copy of <br />each claim sent to the City. Cimarron will prepare a year-end <br />report on all claims and their disposition for Council review. <br />Their performance will be a factor in determining the renewal <br />of the Conditional Use Permit. <br />
