R-84-43 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AMENDING R84-7 GRANTING A CONDITIONAL <br />USE PERMIT TO RICHARD BERGMANN, BERRY FARM <br />GREENHOUSE, FOR GREENHOUSE AND SALES LOT TO <br />DECEMBER 31, 1984. <br />WHEREAS, in R84-7, Richard Bergmann applied and received approval <br />of a Conditional Use Permit for greenhouse and sales lot on the South <br />534.9 feet of the North 925.9 feet of the West 1/2 of the Northwest <br />1/4 of Section 1, T29, R21W at 5833 Lake Elmo Avenue North in the City <br />of Lake Elmo from January 1, 1984 thru December 31, 1984; and has <br />submitted all required information and fees for the application for <br />such permit; and, <br />WHEREAS, Richard Bergmann has applied for an expansion of his <br />existing approved Conditional Use Permit; and, <br />WHEREAS, Richard Bergmann has submitted all the required <br />information and fees for the application of such expansion of existing <br />Conditional Use Permit; and, <br />WHEREAS, the Lake Elmo Planning Commission held a public hearing <br />on July 9, 1984 on the application for expansion of this existing <br />Conditional Use Permit and recommended approval to the City Council; <br />and, <br />WHEREAS, the Lake Elmo City Council held a public hearing on this <br />proposed expansion of the existing Bergmann Conditional Use Permit and <br />side yard setback zoning variance on July 17, 1984; and <br />WHEREAS, Richard Bergmann's application is to expand his existing <br />Conditional Use Permit to the Northeast and the entire area proposed <br />to be under an Conditional Use Permit for a greenhouse and sales lot <br />is legally described as: <br />The South 534.9 feet of the North 925.9 feet of the West 1/2 of <br />the Northwest 1/4 of Section 1, T29, R29W; and, the North 300 feet of <br />the Easterly 640 feet of the East 1/2 of the Northwest 1/4 of the NW <br />1/4 of Section 1, T29, R29W. <br />WHEREAS, Section 301.070 b (1) and (5) for the Municipal Code of <br />Lake Elmo requires a Conditional Use Permit to operate a greenhouse <br />and sales lot in the City of Lake Elmo; and <br />WHEREAS, Section 301.130 c, d, e, f, g of the Municipal Code of <br />Lake Elmo sets forth the conditions under which said permit may be <br />granted and such use permitted; and, <br />WHEREAS, the applicant meets or exceeds all the conditions set <br />forth above: <br />
