R84-54 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 84-54 <br />RESOLUTION AUTHORIZING EXECUTION OF <br />JOINT POWERS AGREEMENT WITH WASHINGTON COUNTY <br />REGARDING SEWAGE IMPROVEMENTS. <br />WHEREAS, 1983 Minn. Laws Ch. 118 (the "Special Law") <br />provides that pursuant to joint powers agreements with cities and <br />towns in Washington County, Minnesota (the "County"), the County <br />may acquire, construct, install and improve, on behalf of such <br />cities and towns, sewage disposal facilities which are disposal <br />systems or parts of systems; and may issue its general obligation <br />bonds to finance such activities; and <br />WHEREAS, the County has received confirmation of grants <br />(the "Grants") from the United States Environmental Protection <br />Agency and the Minnesota Pollution Control Agency for a project <br />(the "Project") involving sewage treatment improvements in <br />certain cities and towns within the County; and <br />WHEREAS, the County proposes to undertake the Project <br />pursuant to the Special Law to be financed by the proceeds of the <br />Grants and its general obligation bonds and therefore desires to <br />enter into a joint powers agreement with various cities and towns <br />in the County pursuant to the Special Law; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LAKE ELMO, MINNESOTA AS FOLLOWS: <br />The Mayor and the City Administrator of the City of Lake <br />Elmo (the "City") are hereby authorized and directed to execute <br />the joint powers agreement substantially in the form attached <br />hereto, with only such additions, modifications and deletions as <br />are not to the detriment of the City. <br />Adopted by the City Council this 18th day of September, <br />1984. <br />Mayna d L.
