RESOLUTION R84-69 CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO RICHARD BERGMANN, BERRY FARM GREENHOUSE, FOR GREENHOUSE AND SALES LOT FROM JANUARY 1, 1985 THRU DECEMBER 31, 1985. WHEREAS, Richard Bergmann has applied for a Conditional Use Permit for a Greenhouse and Sales Lot on the South 534.9 feet of the North 925.9 feet of the West 1/2 of the Northwest 1/4 of Section 15T29, R21W and the North 300 feet feet of the Easterly 640 feet of the East 1/2 of the Northwest 1/4 of the Northwest 1/4 of Section 1 T29N, Range 21W, at 5833 Lake Elmo Avenue North in the City of Lake Elmo from January 1, 1985 through December 31, 1985; and has submitted all required information and fees for the application for such permit; and, WHEREAS, Section 301.070 D. l.b. (1) and (5) of the Municipal Code of Lake Elmo requires a Conditional Use Permit to operate a Greenhouse and Sales Lot in the City of Lake Elmo; and, WHEREAS, Sections 301.130 C.,D.,E., and G of the Municipal Code of Lake Elmo sets forth the conditions under which said permit may be granted and such use permitted; and, WHEREAS, the applicant meets or exceeds all the conditions set forth above. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo, THAT, the Conditional Use Permit for a Greenhouse and Sales Lot at 5833 Lake Elmo Avenue North is hereby granted to Richard Bergmann from January 1, 1985 through December 31, 1985. This Conditional Use Permit may be rescinded, after a 2 week notice and a public hearing, if the City Council finds that the publics health, safety, or welfare is jeopardized.
