RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING A SIMPLE LOT SUBDIVISION AND ZONING CODE <br />VARINACE TO RUSSELL LOETSCHER AT 3063 JAMLEY AVENUE N. <br />WHEREAS, Russell Loetscher has made application to the City of <br />Lake Elmo for a simple lot subdivision and zoning code lot size <br />variance, on a parcel of land located in said City, into two legally <br />described parcels as follows, to wit: <br />PARCEL A - <br />SEE ATTACHED DESCRIPTIONS <br />PARCEL B - <br />WHEREAS, it appears that the above described land was not at the <br />time of the application seperately described parcels of record; and, <br />WHEREAS, there does not appear to be any reason related to the <br />public health, safety or welfare which would require a denial of this <br />simple lot division; and, <br />WHEREAS, the City Planning Commission considered the proposed <br />simple lot subdivision and zoning code lot size variance on August 27, <br />1984 and recommended approval thereof; and, <br />WHEREAS, the City Council considered the proposed simple lot <br />subdivison and zoning code lot size variance at a Public Hearing on <br />September 18, 1984. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of <br />Lake Elmo as follows to wit: <br />1. The application for a zoning code lot size variance by Russell <br />Loetscher for the above described property is hereby granted based on <br />the hardship that the original property has two homes located on it <br />and has been used as seperate lots for many years. <br />2. The application for a simple lot division by Russell Loetscher <br />for the real estate described above, be and the same hereby is granted <br />provided: <br />A. Mr. Loetscher revises the Certificate of Survey to show <br />Jamley Avenue right-of-way at 30 feet; and, 31st Street N. <br />right-of-way at 33 feet; and, provide the City with these <br />right-of-way deeds. <br />B. Demonstrate that each parcel has sufficient room for a <br />i primary and alternate drain.field site. <br />C. Provide documentation that each lot has a seperate well <br />and driveway access to serve each homesite. <br />
