R-84-2 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO GERALDINE <br />BREHEIM - BREHEIM KENNELS, FOR A DOG KENNELL IN THE R-1 ZONING <br />DISTRICT FROM JANUARY 19 1984 TO DECEMBER 31, 1984. <br />WHEREAS, Geraldine Breheim has applied for a Conditional Use <br />Permit for a dog kennel on Lot 15 of Bordner --Garner Farmettes at <br />8415 38th Street North in the City of Lake Elmo from January 1, <br />1984 through December 31, 1984; and has submitted all required <br />information and fees for the application for such permit; and, <br />WHEREAS, Section 301.050B. of the Municipal Code of Lake <br />Elmo requires a Conditional Use Permit to operate a dog kennel in <br />the City of Lake Elmo; and, <br />WHEREAS, Sections 1402 of the Municipal Code of Lake Elmo <br />sets forth the conditions under which said permit may be granted <br />and such use permitted; and, <br />WHEREAS, the applicant meets or exceeds all the conditions <br />set forth above; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, The Conditional Use Permit for a dog kennel at 8415 <br />38th Street North is hereby granted to Geraldine Bresheim from <br />January 1, 1984 through December 31, 1984, subject to the <br />following conditions; <br />1. There shall be no more than 7 dogs over the age of 6 months <br />in the kennel at any time. <br />2. The use is not transferable. <br />3. The kennel shall be set back 400 ft. from existing property <br />owners. <br />4. The dogs shall be enclosed in runs. <br />This Conditional Use Permit may be rescinded, after <br />a 2 week notice and a public hearing, if the City Council <br />finds that the public health, safety, or welfare is <br />jeopardized. <br />ADOPTED, this the 3rd day of January, 1984, by the City Council <br />of the City of Lake Elmo, Washington County, Minnesota. <br />Signed: �7, eZ¢_v1 <br />Attest: MaynarcY L.
