RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO <br />R.J. O'NEIL FOR VALI-HI DRIVE IN THEATRE IN THE <br />GB ZONING DISTRICT FROM JANUARY 1, 1984 THROUGH <br />DECEMBER 31, 1984. <br />WHEREAS, R.J.O'Neil has applied for a Conditional Use <br />Permit for a drive-in theatre on the SW 1/4, SW 1/4 of Sec. 36, <br />T29, R21, except the S 219.5 ft. of the E. 847.7 ft. thereof, <br />for which a site layout is on file with the City Clerk at 11260 <br />Hudson Boulevard in the City of Lake Elmo from January 1, 1984 <br />through December 31, 1984; and has submitted all required <br />information and fees for the application for such permit; and, <br />required information and fees for the application for such <br />permit; and, <br />WHEREAS, Section 301.070 D. 7. a. (9) of the Municipal <br />Code of Lake Elmo requires a Conditional Use Permit to operate a <br />drive-in theatre in the City of Lake Elmo; and, <br />WHEREAS, Section 301.130 L. of the Municipal Code of <br />Lake Elmo sets forth the conditions under which said permit may <br />be granted and such use permitted; and, <br />WHEREAS, the applicant meets or exceeds all the <br />conditions set forth above; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, the Conditional Use Permit for Vali-Hi Drive -In <br />at 11260 Hudson Boulevard is hereby granted to R.J. O'Neil from <br />January 1, 1984 through December 31, 1984, subject to the <br />following conditions: <br />1. There shall be licensed deputies on duty Fridays, <br />Saturdays and holidays when more than 50 cars are an- <br />ticipated. <br />2. The owner shall prevent litter from this use to scatter <br />to adjoining property. <br />3. The parking area and drives shall be treated to control <br />dust. <br />This Conditional Use Permit may be rescinded after a two week notice and <br />public hearing, if the City Council finds that the public health, safety <br />or welfare is jeopardized. <br />
