LAKE ELMO CITY COUNCIL MINUTES AUGUST 6, 1985 Page 6 <br />costs and property owners releasing the counties liability caused <br />by well contamination could be sometime in September or October. <br />The estimate for the system to be in operation is 1986. <br />Ayers was very pleased with the effectiveness of the gradient <br />control well decontamination system at the landfill. He said one <br />well is still contaminated and one other shows trace contaminants. <br />G. Lake Jane Pumping Program <br />At a July 24 public hearing, the Council explored the following <br />alternatives: pumping Lake Jane to Shafer Gravel Pit; excavating <br />Shafer Pit to hold more overflow water; excavating Lake Jane <br />shoreline, using excess water to irrigate nearby croplands, and <br />pumping to another location, since the holding capacity of the <br />Shafer Pit is limited. <br />The Council discussed pumping Lake Jane overflow to a depression <br />on Mervin Nippoldt's property, south of the landfill or to <br />Breschens' Pond, southeast of Lake Jane. City Engineer Bohrer <br />recommended continued pumping of Lake Jane until December or <br />depending on weather it might go further. This would also depend <br />on the elevation of City Park Pond. He estimated by then the <br />lake's level should be lowered to 922, two feet below flood stage. <br />Before pumping continues beyond October 1, as permitted by the <br />Valley Branch Watershed District (VBWD), the city must obtain <br />permits from the VBWD and the Minnesota Department of Natural <br />Resources. <br />Tom Armstrong, 8291 15th St. N., stated that the reason the 509 <br />Program is bogged down is clearly the funding. The 509 Committee <br />voted to put it on the mill rate and the County Board did not <br />agree and sent it back. The 509 Committee has not been called for <br />a meeting and pressure should be put on the VBWD to start holding <br />meetings at least once a week to get this job done. <br />Christ stated he would like to see the Lake Jane people petition <br />and only assess them and not the Olson and DeMontreville lake <br />property owners. <br />Morgan suggested that the City Engineer look into pumping into <br />Berschens' Pond. <br />M/S/F Morgan/Mazzara - to apply for a permit to pump Lake Jane <br />overflow to a depression on Mervin Nippoldt's property. (Motion <br />failed 2-3<Armstrong, Dunn, Christ - too many unknowns so cannot <br />support it>). <br />H. Castle Design drainage <br />City Engineer enlightened the Council that he has been <br />contacted by one of the residents, Mary Brown, northside of 50th, <br />and they believe this will cause problems in the spring. They <br />feel the city should be liable if the swamp should increase in <br />height because of the closing. Alternative would be to construct <br />
