R85-4 <br />RESOLUTION 85-4 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING THE FINAL PLAT FOR DAVID NELSON ESTATES <br />WHEREAS, the City Council of the City of Lake Elmo has previously <br />considered and approved the preliminary plat of David Nelson Estates; <br />and, <br />WHEREAS, the applicant has now presented to the City a five lot <br />final plat which conforms to the approved preliminary plat and meets <br />the requirements of the City's Subdivision Ordinances; and, <br />WHEREAS, the Lake Elmo Planning Commission has reviewed the <br />proposed final plat at its February 11, 1985 meeting and recommended <br />to the City Council approval of the said final plat. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City <br />of Lake Elmo does hereby accept the final plat of David Nelson Estates <br />as it is on file with the City Clerk subject to the following <br />conditions: <br />1. Submitting plans and specifications for the required public <br />improvements for review and acceptance by the City Engineer. <br />2. Paying park donation fees in the amount of $700. <br />3. The applicant shall enter into a developer's agreement as <br />required by the City Subdivision Ordinance providing for the <br />construction of all streets and related improvements to City <br />Standards. <br />4. The developer's performance of said developer's agreement <br />shall be secured by security bond, cash deposit or letter of credit in <br />a form approved by the City Attorney or such other security as may be <br />hereafter approved by the City Council. The amount of said bond shall <br />be determined by the City Engineer in accordance with the provisions <br />of the subdivision ordinance. <br />5. The developer's agreement shall also include all conditions <br />placed upon the developer a- -roc-ommended -by-the Planning Commission -at - its February 11, 1985 meeting, including the recommendations listed in <br />the memo from the City Engineer dated February 7, 1985. <br />ADOPTED by the City Council of the City of Lake Elmo this 19th <br />day of February, 1985. <br />_ 'LT c3,,r Q , C�_ py,) d-1A a"-) <br />David A.
