RESOLUTION 85-5 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AUTHORIZING A ROAD FRONTAGE VARIANCE TO JOSEPH KAISER <br />WHEREAS, the City of Lake Elmo has received an application by <br />Joseph Kaiser for a road frontage variance to allow the construction <br />of a single family residential unit on his property of 6.6 acres <br />described as follows: <br />Parcel A: Plate and Parcel 36-37015-4305 <br />WHEREAS, the Lake Elmo City Council held a public hearing on the <br />request by Joseph Kaiser for a road frontage variance at its March 5, <br />1985 City Council meeting; and, <br />WHEREAS, the City Council received public input from one resident, <br />Mr. Friedrich, relating to existing trees on his property immediately <br />west of the applicant's parcel, and Mr. Friedrich offered support of <br />the request of Mr. Kaiser for a road frontage variance; and, <br />WHEREAS, the Lake Elmo City Engineer has reviewed the proposal and <br />made a number of recommendations to the City Council relating to the <br />construction of a private road. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Lake Elmo that a road frontage variance is hereby authorized to Joseph <br />Kaiser for his parcel of land containing 6.6 acres subject to the <br />following conditions: <br />1. The existing 33 foot wide easement from 31st Street East <br />to the West line of the Kaiser property shall be deeded <br />to the City of Lake Elmo. <br />2. A 30 foot wide easement for access purposes shall be <br />provided along the North line of the Kaiser property to a <br />point approximately 450 feet East of 31st Street to the <br />East line of the Kaiser property, and along the entire -East <br />line of the Kaiser property. <br />3. A private 22 foot road in width shall be constructed <br />from 31st Street East, approximately 450 feet to the point at <br />which the Kaiser driveway would turn to the south. This <br />private road is subject to approval for design and <br />construction by the City Engineer. <br />4. The Kaiser driveway may be reduced to eighteen feet width, <br />south of the private road. <br />5. The line of pine trees on the south side of the existing <br />thirty-three foot wide easement shall be saved, if at all <br />possible. If the trees cannot be saved, substitute trees <br />shall be planted to Mr. Friedrich satisfaction. <br />
