Kaiser (hereinafter called <br />"Devel oper") , <br />WITNESSETH: <br />WHEREAS, the Developer desires to obtain a building permit to construct a <br />rest dent! al dwel I ing on property owned by Developer in the City of Lake <br />Elmo; and <br />WHEREAS, the City has granted the Developer a Road Frontage Variance to <br />at low construction of the aforementioned dwel i Ing on a parcel of land which <br />does not abut on a public right-of-way; and <br />WHEREAS, both the City and the Developer wish to provide for adequate <br />ingress and egress to the residence following its construction; <br />NOW, THEREFORE, and In consideration of the respective agreements and <br />undertakings herein contained, it is agreed by and between the parties as <br />follows: <br />1. Developer shall, along with Jim Friedrich, execute a deed to the City <br />for the 33 foot right-of-way from 31st Street to the east I Ine of the <br />Kaiser parcel (Parcel 36-37015-4305). <br />2. Developer shall provide an easement, 30 feet in width, along the north <br />fine and along the east I i ne of Developer's property as an access to <br />the Jim Friedrich property, Parcel 36-37015-4300. <br />3. Developer shall construct and thereafter maintain a private road on <br />the above described right-of-way and easement, 22 feet in width, from <br />31st Street to approximately 450 feet east to the point where the <br />Kaiser driveway would turn south. <br />The private road shall be 22 feet in width as measured after the <br />finished bituminous surface Is in place. The subgrade shall be graded <br />to provide a uniform crown in the center of the road. Ditches are <br />req u i red In the cut sections to provide drainage. The bottom of the <br />ditch sh al I be a minimum of one (1) foot deep below the edge of the <br />road. The €nslope from the edge of the road and the backslope out of <br />any ditch shal I not be steeper than 3: 1 . Culverts shall be placed at <br />the low point In the road or wherever surface water will accumulate. <br />Sufficient fill shall be placed so that the road Is at Ieast one foot <br />above the highest anticipated level of the adjacent pond. The <br />Compaction Method. The subgrade shal I be toi eranced and a four (4) <br />inch minimum thickness Class 5 gravel base constructed thereon. <br />
