RESOLUTION 85-6 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AMENDING RESOLUTION 84-66 GRANTING A CONDITIONAL USE <br />PERMIT TO CHARLES ANDERSON FOR THE OPERATION OF THE ANIMAL INN <br />WHEREAS, in Resolution 84-66 Charles Anderson applied for and <br />received approval for a Conditional Use Permit to operate the Animal <br />Inn on Pt of the W1/2 of the SE1/4 of Section 16, T29N, R21W, lying <br />between the Southerly right-of-way line of the MN State Trunk Highway <br />212 (5) and the Northerly right-of-way line of the <br />Chicago/Northwestern Railroad at 8533 34th Street North in the City of <br />Lake Elmo from January 1, 1985 thru December 31, 1985; and has <br />submitted all required information and fees for the application for <br />such permit; and, <br />WHEREAS, Charles Anderson has applied for the addition of a dog <br />training facility to be included within his Conditional Use Permit; <br />and, <br />WHEREAS, Charles Anderson has submitted all the required <br />information and fees for the application of such expansion of use of <br />the existing Conditional Use Permit; and, <br />WHEREAS, this approval of a dog training facility was originally <br />given to the Animal Inn by the Lake Elmo City Council at a May 15, <br />1973 meeting; and <br />WHEREAS, the Lake Elmo Planning Commission held a public hearing <br />on January 28, 1985 on the application for the expansion of the use of <br />the existing Conditional Use Permit for the construction of a dog <br />training facility of 50' x 136' with a 40' x 60' area on the front for <br />office space, and recommended approval to the City Council; and, <br />WHEREAS, Section 301.070 D.l.b. of the Municipal Code of Lake Elmo <br />requires a Conditional Use Permit to operate a public dog kennel and <br />training school in the City of Lake Elmo; and, <br />WHEREAS, Section 1402 of the Municipal Code of Lake Elmo sets <br />forth the conditions under which said permit may be granted and such <br />uses permitted; and, <br />WHEREAS, the applicant meets or exceeds all of the conditions set <br />forth above. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Lake Elmo that the Conditional Use Permit amendment for the addition <br />of a rang training facility at the aboyT coil e pi2gpei2ty for the <br />Animal Inn is hereby granted to Charles Anderson thru December 31, <br />1985. <br />
