C� c G ��9� • <br />RESLL UTION-N9, 8 5 - 21 <br />YMAN.CE-RE.Q-luaT <br />.EUM <br />.STATE -RI Q-RIQ11I 9.Ep.WAY-STANDARDS <br />WHEREAS, the City Council of the City of Lake Elmo proposes to construct a <br />28 foot urban designed roadway with 2-way traffic and "No Parking" <br />restrictions on both sides of said roadway described as follows, to-wlt: <br />Lower 33rd Street - Klondike Avenue to CSAH 17 <br />Control Section 101 - Segment 010 <br />WHEREAS, the City Council finds that said construction can be completed, <br />within the existing right-of-way of 33 feet; and, <br />WHEREAS, the City Council finds that the purchase of the additional 27 feet <br />of right-of-way to comply with Minnesota Rules for State Aid Operations, <br />Chapter 8820, Section 8820.2500, Subparagraph 3, "Right of Way Standards" <br />would create undue hardship to the surrounding property by the encroachment <br />on one existing home and removal of one existing home and one commercial <br />building along the southern portion of 33rd Street. <br />NOW, THEREFORE, DE IT RESOLVED, that the City Council of the City of Lake <br />Elmo hereby requests a variance be granted from the required right-of-way <br />width of 60 feet to allow the construction of Lower 33rd Street North on <br />the existing 33 feet of right-of-way. <br />Adopted by the City Council of the City of Lake Elmo this T dday of <br />_ AAA, _______, t9 <br />19,c+,tmv, � <br />May or <br />ATTEST: <br />7 <br />Clty Clerk <br />
