RESOLUTION 85-28 <br />CITY OF LAKE ELMOs'S <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION VACATING AN EASEMENT OVER AND ACROSS THE WESTERLY <br />20 FEET OF LOTS FOURTEEN (14), FIFTEEN (15), SIXTEEN (16), <br />SEVENTEEN (17) AND EIGHTEEN (18) OF BLOCK THREE <br />(3) OF CLOVERDALE ADDITION TO THE CITY OF LAKE ELMO. <br />WHEREAS, at a regular meeting of the City Council of the City <br />of Lake Elmo, Washington County, Minnesota, held on August 20, <br />1985, a Petition was presented to the City Council praying for the <br />vacation of a certain twenty (20) foot easement in the plat of <br />Cloverdale Addition described as follows: <br />The westerly twenty (20) feet of Lots 14, 15, 16, 17 and 18 <br />of Block 3, Cloverdale Addition <br />WHEREAS, said Petition came on for hearing before said City <br />Council at a regular meeting thereof held at 7:45 p.m on Tuesday, <br />August 20, 1985 in the City Hall pursuant to Notice thereof <br />published and posted as required by law; and, <br />WHEREAS, that part of Lots 14, 15, 16, 17 and 18 of Block 3, <br />Cloverdale Addition has never been opened or used for pedestrians <br />and vehicles as a means of ingress to and egress from the property <br />of the grantor lying North of said lots, and it is improbable that <br />there will ever be any public need for said easement; moreover,by <br />vacating the same, the property will be returned to the tax rolls <br />and would enhance the taxable value of all the land abutting <br />thereon or affected thereby; and <br />WHEREAS, for the foregoing reasons, it appears to be in the <br />public interest to vacate said easement. <br />NOW, THEREFORE, BE IT RESOLVED, that the twenty (20) foot <br />easement as dedicated in the plat of Cloverdale Addition described <br />above be, and the same hereby is, vacated. <br />BE IT FURTHER RESOLVED, that the Clerk shall prepare a Notice <br />of Completion of these proceedings which shall contain the name of <br />the City, and the identification of the vacation, a statement of <br />the time of completion thereof and a description of the real <br />estate and land affected thereby. Such Notice shall be presented <br />to the Washington County Auditor who shall enter the same in his <br />transfer records and note upon the instrument over his official <br />signature the words "entered in the transfer records". The Notice <br />shall then be filed with the County Recorder, all as required by <br />Section 368.01 Subdiviion 25 of the Minnesota Statutes. <br />his 20th day of <br />r <br />
