LAKE ELMO CITY COUNCIL MINUTES APRIL 1, 1986 PAGE 7 <br />Berube vs. the City of Lake ELmo. Mr. Alford is asking the City <br />to consider favorably a variance and building permit for a summer <br />cottage of a smaller size with suitable set back variances and <br />variances for a self-contained septic system of the pump variety. <br />City Attorney Knaak recommended that the City Council not accept <br />this settlement offer under the circumstances because this was <br />fought on the fact for the purpose of strictly enforcing the code. <br />The City Council has taken a tough stand and we might be <br />establishing a precident. <br />The City Council will leave this as an agenda item for the next <br />meeting. There is need to get more information from Alford for <br />the City Engineer's consideration. <br />M/S/P Armstrong/Mazzara - to adjourn the City Council meeting at <br />10:15 p.m. (Motion carried 4-0). <br />Resolution 86-24 - Accept the 1.5 acre donated by the Brookfield Co. <br />for construction of a new City Hall with the <br />three conditions set forth and with a request <br />for a warranty deed. <br />Resolution 86-25 - granting a simple lot subdivision and a shoreland <br />variance to Constance Smith at 3200 Lake Elmo Ave. <br />Resolution 86-31 - authorizing the Mayor and City Council to enter <br />into an agreement with TKDA for architectual <br />& engineering services for the City Hall and <br />Council Chambers <br />
