LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 5, 1986 PAGE 3 <br />6. Public Hearing : Variance to the 30 foot Setback from a <br />Public Road; Robert Molitor, 9133 Jane Road N. <br />Acting Mayor Christ opened up the public hearing at 7:45 p.m. in the <br />City Council chambers. <br />Robert Molitor (agent for B.J. O'Sullivan, Jr. property owner) is <br />applying for a shoreland permit to construct a new septic system to <br />replace the existing system at 9133 Jane Road. Since this property is <br />on the north shore of Lake Jane, shoreland regulations apply. <br />City Engineer Bohrer reported that the old drainfield is probably on <br />the lake side of the property. The applicant proposes to re -use the <br />existing septic tank, install a pump station and construct a new <br />drainfield with drop boxes on the road side of the property. <br />The septic system as proposed can meet the applicable City Codes <br />except for setbacks. Bohrer pointed out the following variances would <br />be required: <br />1. Variance from Shoreland Regulations to allow a portion <br />of the drainfield at 65 feet from High Flood Mark where <br />75 feet is required. <br />2. Variance from Septic System Code to allow a portion of <br />the drainfield to be less than 10 feet from the street <br />right-of-way line. The proposed layout shows one trench <br />on the right-of-way line and one trench in the right-of-way <br />by 7 feet. <br />City Engineer Bohrer recommended that the variances be granted due to <br />the hardship that there is no other available land. City Attorney <br />Knaak felt that this hardship was legally sufficient. Bohrer sees no <br />adverse environmental effects by granting the variances. <br />In the case of Variance No.l, the purpose of the setback from the High <br />Flood Mark is protection of water quality. The lowest drainfield <br />trench in this case will be approximately 7 feet above the high flood <br />mark and will provide adequate sewage treatment. <br />In the case of Variance No.2, the purpose of the road setback is to <br />protect the drainfield from damage if the public utilities are <br />installed or the road widened. The closest trench is proposed to be <br />15 feet from the edge of the blacktop. There will be no damage to the <br />road from the placement of this drainfield trench. The applicant <br />should be advised, however, that the City cannot be responsible for <br />this drainfield trench if utilities are installed or the street <br />widened. <br />If the Council views these variances favorably, Bohrer recommends the <br />following conditions. <br />1. The existing septic tanks should be dug up and checked <br />for baffles and its condition. Inspection pipes should be <br />extended to 6 inches below the surface. <br />
