RESOLUTION 86-8 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO HOWARD <br />SPRINGBORN AND GAYLEN SPRINGBORN - GREEN ACRES, INC. FOR <br />COMMERCIAL RECREATION OF A RURAL NATURE IN THE AG ZONING <br />DISTRICT FROM JANUARY 1, 1986 THRU DECEMBER 31, 1986 <br />WHEREAS, Howard and Gaylen Springborn have applied for a <br />Conditional Use Permit for Commercial Recreation of a Rural Nature on <br />Section 43 T29, R21, 80A S1/2 of NE1/4 except 37004-2205, at 8989 55th <br />Street North in the City of Lake Elmo from January 1, 1986 through <br />December 31, 1986; and has submitted all required information and fees <br />for the application for such permit; and <br />WHEREAS, Section 301.070 D.l.b. (4) of the Municipal Code of <br />Lake Elmo requires a Conditional Use Permit to operate a Commercial <br />Recreation of a Rural Nature in the City of Lake Elmo; and, <br />WHEREAS, Sections of the ZONING ORDINANCE of the Municipal <br />Code of Lake Elmo sets forth the conditions under which said permit <br />may be granted and such use permitted; and <br />WHEREAS, the applicant meets or exceeds all the conditions <br />set forth above. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, the Conditional Use Permit for Commercial Recreation <br />of a Rural Nature at 8989 55th Street North is hereby granted to <br />Howard and Gaylen Springborn from January 1, 1986 through December 31, <br />1986, subject to the following conditions: <br />1. This permit provides for a tube slide and ski hill with <br />lift, ice skating, sleigh rides and hay rides and paddle <br />boats on the lake only. <br />2. The speakers shall be directed so as not to disturb <br />adjacent neighbors. <br />3. The operation shall be closed at 10:00 p.m. <br />4. There shall be no more than 12 parties or events after <br />these closing hours in any one year. <br />This Conditional Use Permit may be rescinded, after a 2 <br />week notice and a public hearing, if the City Council <br />finds that public health, safety, or welfare is <br />jeopardized. <br />ADOPTED, this 7th day of January 1986, by the City Council <br />of the City of Lake Elmo, Washington County, Minnesota. <br />S i gn e d %9 rr G. ,h.n �� <br />David A.
