RESOLUTION 86-13 CITY OF LAKE ELMOj�'po'tui/% WASHINGTON COUNTY, MINNESOTA A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO SHAPER CONTRACTING CO., INC., BOX A, SHAFER, MINNESOTA TO ENGAGE IN MINING OPERATIONS FROM JANUARY 1, 1986 THROUGH DECEMBER 31, 1986 WHEREAS, Shafer Contracting Co., Inc. has applied for a Conditional Use Permit to engage in mining operations on the property described as follows: The Southwest Quarter of the Northeast Quarter of the Northeast Quarter (SW1/4 of NW 1/4 of NE 1/4) of Section Sixteen (16), Township Twenty-nine (29), Range Twenty-one (21) West. WHEREAS, Section 901.030 of the Municipal Code of Lake Elmo requires a Conditional Use Permit to engage in mining operations; and., WHEREAS, Section 901 of the Municipal Code of Lake Elmo sets forth the conditions under which said permit may be granted and such use permitted; and, WHEREAS, the applicant meets or exceeds all the conditions set forth above. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo, THAT, the Conditional Use Permit for Mining Operations at the above described parcel is hereby granted to Shafer Contracting Co., Inc from January 1, 1986 thru December 31, 1986 subject to the following conditions: 1. All operations conducted hereunder must be in accordance with the plan for such operations on file in the office of the City Administrator. 2. Adherence to said plan shall be in accordance with the reasonable directions of the Building Official. 3. All operations permitted by this Conditional Use Permit shall be under the terms and conditions of Section 901 of the Municipal Code of 1979 relating to mining ( a copy of which is attached hereto). 4. The term of this Conditional Use Permit shall be for the 1986 season which terminates December 31, 1986. l This permit is issued by the City of Lake Elmo pursuant to its Municipal Code. This permit does not purport to permit any improvement, use of activity which may be prohibited or regulated by other governmental agencies having jurisdiction over said land of the subject matter of this permit.
