WHEREAS, the Developers hereby warrant and represent to the City as <br />inducement to the City's entering into this Agreement that Developer's <br />interest in the land area of the Development is fee owner. <br />WHEREAS, the City Council, by resolution adopted , has <br />granted preliminary approval to the Development, on the condition that the <br />Developers enter into this agreement to provide for the installation of <br />streets, utilities, landscaping and other improvements hereafter described <br />in the terms and conditions hereafter set forth. <br />NOW, THEREFORE, and in consideration of the premises and of the mutual <br />promises and conditions hereinafter contained, it is hereby agreed as <br />follows: <br />In accordance with the policies and ordinances of the City, the <br />following described improvements shall be constructed and installed on <br />the terms and conditions hereinafter contained: <br />A. Street grading, graveling and stabilizing, bituminous surfacing, <br />bituminous curb, construction of berms and boulevards, and turf <br />restoration Including seeding and mulching (hereinafter called <br />"Street Improvements); <br />B. Drainage facilities, Including all necessary storm sewers, catch <br />basins, ponds, inlets and other appurtenances as well as seeding <br />and mulching (hereinafter called "Storm Sewer Improvements"); <br />( C. Standard street name signs at all newly opened intersections and <br />such other traffic control signs within the subdivision <br />determined to be necessary by the City Engineer (hereinafter <br />called "Traffic Signing Improvements"); <br />D. Underground gas, electric and telephone service to be arranged <br />by the Developers with the utility companies involved <br />(hereinafter called "Utility Improvements"). <br />2. DESIGN, INSPECTION AND AS-BUIITS AND WARRANTY PEJAM TO IMPROV mENTS <br />Prior to any construction, plans and specifications for ail storm <br />sewer facilities, grading, bituminous curb and bituminous surfacing, <br />whether to be public or private shall be prepared by a Registered <br />Professional Civil Engineer and submitted to the City Engineer for <br />approval. The Developer, through his Engineer, shall provide for <br />competent dally Inspection of all street and utility construction, <br />both public and private. As -built drawings on reproducible mylar and <br />certificates of completion and compliance with approved specifications <br />shall also be delivered to the City Engineer. <br />Prior to acceptance by the City of any streets or utilities or <br />commencement of maintenance thereof by the City, the City Engineer <br />shall inspect and approve the same and signify his approval for <br />acceptance In writing. <br />-2- <br />
