R86-25 page 2 <br />of 275.39 feet to the southeast corner of said Lot 1; thence South 56 <br />degrees 49 minutes 39 seconds West, along the southeasterly line of <br />said Lot 1, a distance of 546 feet, more or less, to the shore of Lake <br />Elmo; thence northerly and northwesterly, along said shore of Lake <br />Elmo, a distance of 225 feet more or less, to its intersection with a <br />line that bears South 22 degrees 38 minutes 25 seconds West from the <br />point of beginning; thence North 22 degrees 38 minutes 25 seconds <br />East, a distance of 267 feet, more or less, to the point of beginning. <br />This parcel contains 4.38 acres, more or less. <br />WHEREAS, the Lake Elmo Planning Commission considered this <br />application on March 10, 1986 and recommended denial of the <br />application as the applicant did not meet the Lake Elmo Municipal Code <br />requirement of 1-1/2 acres and the applicant did not meet the required <br />150' lake frontage; and <br />WHEREAS, the applicant realigned the lots to accomodate the <br />1-1/2 acre requirement in the Lake Elmo Municipal Code; and <br />WHEREAS, the City Council interpreted the odd shape of the <br />lot a hardship in granting a lake frontage variance from the required <br />150"; this variance being the only variance required with this simple <br />lot subdivision request. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br />of Lake Elmo as follows, to wit: <br />The application of Constance Smith for a simple lot subdivision for <br />the above described Parcels A and B shall be approved as separately <br />subdivided parcels. <br />ADOPTED by the City Council of the City of Lake Elmo this 1st <br />day of April, 1986. <br />Attest: <br />ert Lee"Overby, City <br />IV <br />Signed: <br />David A. <br />nistrator <br />A. el-n 0-20 � <br />Morgan, Mayor <br />
