LAKE ELMO CITY COUNCIL MINUTES MAY 19, 1987 page 6 <br />{ At this time, Bohrer did not know if a variance was needed. <br />Ed Stevens, 10133 47th Street N., presented slides of his large oak <br />trees and of other areas in Lake Elmo where streets have been built in <br />such a fashion as to avoid taking out trees. A petition for <br />preserving the trees was presented by Mr. Stevens. Stevens obtained <br />legal advice on whether the trees are on his land or City land. The <br />answer he received in this case was the public only owns the width of <br />the street that is in actual use. The trees are on his land and it <br />would be necessary to condemn his property in order to cut down the <br />trees and widen the road. <br />Graves explained the intent of this motion was to initiate activity <br />and find out what options we have for putting up barriers or rerouting <br />the roadway. Adop% PP6o(07-�6A) 97-46 <br />M/S/P Graves/Moe - to instruct the City Engineer to prepare a <br />feasibility report on paving 47th Street N. according to MSA standards <br />and as a MSA project. (Motion carried 5-0). <br />C. 201 Project Update <br />Authorization to Advertise for Bids on Part D <br />The City has now received authorization from the MPCA to advertise for <br />bids on Part D. The first advertisement will appear in the legal <br />newspaper on May 20 and the Construction Bulletin on May 22. A 30-day <br />advertisement period is required. The Bid Opening has been scheduled <br />for 1:00 p.m. on June 19, 1987 in the City Hall. <br />Since time is of the essence in getting the City's grant amended, City <br />Engineer Bohrer recommended that the Council schedule a special. <br />meeting on June 22 or 23 to consider the bids. <br />M/S/P Moe/Graves to hold a special City Council meeting on Monday, <br />June 22nd at 4:30 in the City Council chambers to consider the bids <br />.for Part D of the 201 Program. (Motion carried 5-0). <br />Partial Payment No. 6 to Widmer Inc. <br />City Engineer Bohrer presented for the Council's review and approval <br />Estimate and Certificate No. 6 to Widmer, Inc. for $187,895.22. The <br />money for this payment is available from the County's pooled bond <br />account. As of this estimate, 100% of the on -site systems have been <br />installed and are functioning. Only the landscaping remains. The <br />estimated remaining project cost is $140,000. <br />- M/S/P Armstrong/Moe - to approve Partial Payment No. 6 for $187,895.22 <br />to Widmer, Inc. for work done on Parts A-B-C of the 201 Program. <br />,(Motion carried 5-0). <br />D.
