R87-46 Federal Land Company PUD denial <br />Page 3 <br />8. The Federal Land Company PUD is not consistent with the goals and <br />policies for commercial land use management in Lake Elmo. <br />9. Commercial and office/warehouse development at the site of the <br />proposed Federal Land Company PUD is not consistent with the 1986 <br />Comprehensive Plan. <br />10. The 56-acre Federal Land Company PUD would provide new commercial <br />development in excess of the level provided for in the 1986 <br />Comprehensive Plan. The PUD site is also located outside of the two <br />areas in Lake Elmo (old village and MUSA) that have been provided by <br />the 1986 Comprehensive Plan for commercial development. <br />11. The 1986 Comprehensive Plan indicates an agricultural future land <br />use for the Federal Land Company PUD site. Rezoning to PUD would not <br />be supported by the 1986 Comprehensive Plan in its current form. The <br />Plan would have to be amended in order to allow the City to consider <br />the PUD project beyond the General Concept Plan review point. <br />12. The 1986 Comprehensive Plan does not provide for commercial <br />development as a future land use on the Federal Land Company PUD site. <br />The Plan would have to be amended before the City could proceed with <br />further consideration of this proposed project. <br />13. An excerpt from a letter from Barbara G. Sennes of the <br />Metropolitan Council dated March 10, 1987 states in part "Lake Elmo <br />should be aware that in its sewer policy plan, the Council strongly <br />states that the in situ local unit of government bears the burden of <br />of insuring that local sewer facilities do not cause a health or <br />safety problem. The Council does not intend to provide metropolitan <br />sewer service in the rural service area and any necessary remedial <br />measures would be the city's responsibility". <br />Now, therefore, be it resolved that for the above listed findings <br />of fact, the Lake Elmo City Council finds the Federal Land Company <br />proposed Planned Unit Development (PUD) to be inconsistent with the <br />City's 1979 and 1986 Comprehensive Plan and is therefore denied. <br />Adopted by the City Council of the City of Lake Elmo this 1st day <br />of September, 1987. <br />Rober <br />Approved <br />Arlyn Ch ist, Mayor <br />ederic Knaak, City Attorney <br />
