[us <br />RESOLUTION 87-10 5�� <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING A CONDITIONAL USE: PERMIT TO HELEN MILLER <br />FISHER. FOR A PRIVATE DOG KENNEL IN THE R-1 ZONING DISTRICT FROM <br />JANUARY 1, 1987 THRU DECEMBER 31, 1987 <br />WHEREAS, Helen Miller Fisher has applied for a Conditional <br />Use Permit for a private dog kennel on Lots 23-23 of Bordner -Garner <br />Farmettes at 8139 38th Street North in the City of Lake Elmo from <br />January 1, 1987 through December 31, 1987; and has submitted all <br />required information and fees for the application for such permit; <br />and, <br />WHEREAS, Section 301.050B of the Municipal Code of Lake Elmo <br />requires a Conditional Use Permit to operate a private dog kennel in <br />the City of Lake Elmo; and, <br />WHEREAS, Sections 1402 of the Municipal Code of Lake Elmo <br />sets forth the conditions under which said permit may be granted and <br />such use permitted; and, <br />WHEREAS, the applicant meets or exceeds all the conditions <br />set forth above. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, The Conditional Use Permit for a private dog kennel at <br />8139 38th Street North is hereby granted to Helen Miller Fisher from <br />January 1, 1987 through December 31, 1987, subject to the following <br />conditions: <br />1. No dogs may be boarded. <br />2. This use is not transferable <br />3. No open burning is allowed on this <br />property per State Statute. <br />This Conditional Use Permit may be rescinded, after <br />a 2 week notice and a public hearing, if the City <br />Council finds that the public health, safety, or <br />welfare is jeopardized. <br />ADOPTED, this 6th day of January, 1.987, by the City Council <br />of the City of Lake Elmo, Washington County, Minnesota. <br />Signed.: Lx`� �" <br />CP� Arlyn UlTrist, Mayor <br />Attest: <br />Robert Lee Overby, City/Administrator <br />
