RESOLUTION 87-14 1(,0 <br />CITY OF' LAKE ELMO j <br />WASHINGTON COUNTY, MINNESOTA J �� <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO R.J. O'NEIL <br />FOR VALI-HI DRIVE IN THEATRE IN THE GENERAL BUSINESS ZONING <br />DISTRICT FROM JANUARY 1, 1987 THRU DECEMBER 31, 1987 <br />WHEREAS, R.J. O'Neil has applied for a Conditional Use <br />Permit for a drive-in theatre on the SW1/II, SW1/4 of Section 36, T29, <br />R21, except the S 219.5 feet of the E. 847.7 feet thereof,(for which a <br />site layout is on file with the City Clerk) at 11260 Hudson Boulevard <br />in the City of Lake Elmo from January 1, 1987 through December 31, <br />1987 ; and has submitted all required information and fees for the <br />application for such permit; and <br />WHEREAS, Section 301.070 D.7.a.. (9) of the Municipal Code of <br />Lake Elmo requires a Conditional Use Permit to operate a drive-in <br />theatre in. the City of Lake Elmo; and, <br />WHEREAS, Sections 301.130 L of the Municipal Code of Lake <br />Elmo sets forth the conditions under which said permit may be granted <br />and such use permitted; and <br />WHEREAS, the applicant meets or exceeds all, the conditions <br />set forth above. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Lake Elmo, <br />THAT, the Conditional Use Permit for Vali-Hi Drive -In at <br />11260 Hudson Boulevard is hereby granted to R.J. O'Neil from January <br />1, 1987 through December 31, 1987, subject to the following <br />conditions: <br />1. There shall be licensed deputies on duty Fridays, Saturdays <br />and holidays when more than 50 cars are anticipated. <br />2. The owner shall prevent litter from this use to scatter <br />to adjoining property. <br />3. The parking area and drives shall be treated to control <br />dust. <br />This Conditional Use Permit may be rescinded, after a 2 <br />week notice and a public hearing, if the City Council <br />finds that public health, safety, or welfare is <br />jeopardized. <br />ADOPTED, this 6th day of January 1987, by the City Council <br />of the City of Lake Elmo, Washington County, Minnesota. <br />Signed cg . <br />Arlyn CVrist, Mayor <br />Attest: <br />Robert Lee Overby, Cit Administrator <br />
