NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br />of Lake ELmo, that a Conditional Use Permit for an alternative <br />agricultural use as allowed by Section 301.070 D.1.b.(6) is hereby <br />granted to Howard Gelb and Trans -City Investments subject to such <br />other restrictions and additions as may be herein, -after specified; <br />and that the Conditional Use Permit granted herein is valid from May <br />5, 1987 through December 31, 1987, subject to the following findings <br />and conditions: <br />1. All of the landower's contiguous real estate (40 acres) is <br />zoned agicultural and would be included in the granted CUP. <br />P <br />2. The 5-acre site for alternative agricultural business uses <br />exceeds the 1.5 acre per 40 acres allowed, but that a <br />variance to this ordinance was granted by the City Council <br />on June 2, 1987. <br />3. The 40-acre parcel size qualifies for an alternative <br />agricultural use Conditional Use Permit. <br />4. The landowner is not the owner and operator of the alternate <br />agricultural uses and does not reside on the contiguous real <br />estate, but that variances to these requirements were <br />granted by the City Council on June 2, 1987. <br />5. The applicant was granted a variance by the City Council <br />on June 2, 1987 to allow alternate agricultural uses in an <br />existing non-agricultural style building with exisitng <br />signs and existing lighting. <br />6. The variance to allow alternate conditional uses on a 5-acre <br />site does not include the area occupied by the existing <br />septic system and drainfield, which are considered exceptions <br />to the 5-acre limitation. The need for expansion and <br />improvement of the two existing septic systems, as indicated <br />by the City Engineer's site visit, shall be allowed outside <br />the 5-acre conditional use site. <br />7. Outside storage of vehicles or goods is not anticipated on <br />the site at this time. <br />8. A landscaping plan should be submitted and determined to be <br />adequate to screen the 5-acre site within a time period <br />- to be specified by the City. <br />9. The alternate agricultural conditional uses will not require <br />public sewer or public water. <br />10. The remaining 35 acres should be maintained in accordance with <br />the required practices of the Washington County Soil and <br />Water Conservation District. <br />11. No use allowed under this Conditional Use Permit shall cause <br />pollution, nor shall any hazardous materials be stored on <br />the site. <br />
