LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 15, 1988 PAGE 3 <br />M/S/P Moe/Graves - to direct the City Staff to talk to Roger/Everett <br />Beaubien and research this subdivision, if and when it was granted by <br />the City Council, and to set up a public hearing for December 6th for <br />a Shoreland ordinance variance. (Motion carried 4-0). <br />B. Shoreland Permit: David Schwarz <br />1.0961 32nd St. N. <br />David Schwarz had applied for. a Shoreland Permit to construct a <br />replacement garage for his existing detached garage which is in poor <br />condition. The garage will be located at 10961 32nd St. N. and is <br />along the north shore of Lake Elmo. The existing garage does not meet <br />the required setbacks and this new garage will replace the old one. <br />The applicant proposes 20 feet setback from the street whereas 50 feet <br />is required. This setback does conform to the rest of the garages on <br />the street which are located close to the street because of the steep <br />sloping topography. <br />The proposed garage size is 38' x 2.6' = 988 sq.ft. which is less than <br />the 1,000 SF accessory structure allowed in the code. Bohrer stated a <br />more typical size double car garage such as 24' x 24' might be <br />installed without a side yard variance and not intefere with the <br />septic system. The smaller garage would also leave more room for an <br />alternate drainfield site for the future. The diagram supplied with <br />the application implied that a portion of the drainfi_eld is in the <br />way. <br />Two variances are needed for sideyard setback and setback from the <br />street. No hardship was listed in the application. A public hearing <br />will be scheduled for December 6th. <br />M/S/P Graves/Armstrong - to direct the staff to discuss consideration <br />of a smaller garage with David Schwarz, 10961 32nd St., and to set up <br />a public hearing for a Shoreland Permit and Variances for construction <br />of a replacement garage for his existing detached garage. (Motion <br />carried 4-0). <br />6. CITY ENGINEER'S REPORT: <br />A. Final Paymnt: Lake Area Utility Contracting <br />City Engineer Bohrer reported the work on Part D of the 201 Project <br />performed by Lake Area Utility Contracting is complete and ready for <br />final acceptance. The Council reviewed Compensation Change Order No. <br />9 in the amount of (Deduct) $4,030.04 which reduced the original <br />contract amount to the final as -built amount and Final Estimate and <br />Certificate No. 7 in the amount of $1,380.00. <br />M/S/P Graves/Moe - to accept the work for Part D of the 201 Project, <br />approve Compensating Change Order No. 9 in the amount of (Deduct) <br />$4,030.04 and approve Final Estimate and Certificate No. 7 and issue <br />payment of $1,380.00 to Lake Area Utility Contracting. (Motion <br />i carried 4-0). <br />
