RESOLUTION NO. 88-48. <br />RESOLUTION DESIGNATING PAYMENT OF FEE IN LIEU OF PARK LAND DONATION, <br />UNDER THE PROVISIONS OF THE SUBDIVISION ORDINANCE <br />WHEREAS, the City of Lake Elmo has adopted various subdivision <br />ordinances and resolutions providing for the donation of park land or, <br />in the alternative, the payment of a fee to the City when property is <br />subdivided; and <br />WIiEREAS, Lake Elmo City Code Section 401.400 provides for park <br />donation requirements for plats; and <br />WHEREAS, Resolution 85-12 provides for payment of $250 per lot <br />in lieu of park land dedication on minor subdivisions; and <br />WHEREAS, the Lake Elmo Park Commission and Planning Commission <br />have reviewed the subdivision/park fee donation requirements and has <br />recommended to the City Council that these fees be increased from the <br />current $250 to $450 per lot, or per unit, for all subdivisions; and <br />WHEREAS, the Lake Elmo City Council has considered the <br />recommendation from the Park Commission and Planning Commission to <br />increase the park donation fees on all subdivisions to $450 per lot. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br />of Lake Elmo: <br />1. Effective immediately, all subdivisions shall pay to the <br />City a fee of. $450 per lot, or per unit, in lieu of park <br />land donation at the time of Final Plat approval by the <br />Council. This provision includes all simple and large lot <br />subdivisions. <br />2. That the City Administrator is authorized and directed to <br />determine what parcels are affected and to collect said fee. <br />ADOPTED by the City Council of the City of Lake Elmo this 4th day of <br />October, 1988. <br />SIGNED: (" <br />Arlyn Ch st, Mayor <br />AT.4at <br />4Morri on, City Administrator <br />
