THIS AGREEMENT, made and entered Into th Is -/ ' - day of y�-� a , 1988, by and between the City of Lake Elmo, a Minnesota Municipal Corporation (hereinafter called "City") and Brian F. Crombie and M. Kathleen Crombie, husband and wife (hereinafter called "Developer"), WITNESSETH: WHEREAS, the Developer has made application to the City Council for approval of a land development within the corporate limits of the City, described as follows: That part of Tract B of Registered Land Survey No. 91, accordtng to the Registered Land Survey recorded in the office of the Registrar of Titles, Washington County, Minnesota, lying westerly of the East 135.50 feet thereof and lying southeasterly of the southeasterly line of F.J. Crombie Estates, according to the plat on file in the office of said Registrar of Titles (Certificate of Title No. 37172). Also, Tract H of Registered Land Survey No. 98, according to the Registered Land Survey recorded in said office of the Registrar of Titles, except that part thereof platted as said F.J. Crombie Estates and also except that part thereof described as follows: Commencing at the most northeasterly corner of said Tract H; thence South 01 degrees 44 minutes 39 seconds East, bearing oriented to said Registered Land Survey No. 98, along the east line of said Tract H a distance of 210.00 feet to the point of beginning; thence continue South 01 degrees 44 minutes 39 seconds East along said east Ilne 237.91 fleet to the southerly Iine of said Tract H; thence South 88 degrees 25 minutes 48 seconds West along said southerly line 516.00 feet; thence North 63 degrees 38 minutes 48 seconds East 567.55 feet to the point of beginning. WHEREAS, the Developers hereby warrant and represent to the City as inducement to the City's entering into this Agreement that Developer's interest in the land area of the Development is fee owner. WHEREAS, the City Council, by resolution adopted November i, 1988, has granted preliminary approval to the Development, on the condition that the Developers enter into this agreement to provide for the installation of streets, utilities, landscaping and other improvements hereafter described in the terms and conditions hereafter set forth.
