1 1•L_\ i ,. 11.. <br />THIS AGREEMENT, made and entered Into th Is -/ ' - day of y�-� a , 1988, <br />by and between the City of Lake Elmo, a Minnesota Municipal Corporation <br />(hereinafter called "City") and Brian F. Crombie and M. Kathleen Crombie, <br />husband and wife (hereinafter called "Developer"), <br />WITNESSETH: <br />WHEREAS, the Developer has made application to the City Council for <br />approval of a land development within the corporate limits of the City, <br />described as follows: <br />That part of Tract B of Registered Land Survey No. 91, accordtng to <br />the Registered Land Survey recorded in the office of the Registrar of <br />Titles, Washington County, Minnesota, lying westerly of the East <br />135.50 feet thereof and lying southeasterly of the southeasterly line <br />of F.J. Crombie Estates, according to the plat on file in the office <br />of said Registrar of Titles (Certificate of Title No. 37172). <br />Also, Tract H of Registered Land Survey No. 98, according to the <br />Registered Land Survey recorded in said office of the Registrar of <br />Titles, except that part thereof platted as said F.J. Crombie Estates <br />and also except that part thereof described as follows: <br />Commencing at the most northeasterly corner of said Tract H; <br />thence South 01 degrees 44 minutes 39 seconds East, bearing <br />oriented to said Registered Land Survey No. 98, along the east <br />line of said Tract H a distance of 210.00 feet to the point of <br />beginning; thence continue South 01 degrees 44 minutes 39 <br />seconds East along said east Ilne 237.91 fleet to the southerly <br />Iine of said Tract H; thence South 88 degrees 25 minutes 48 <br />seconds West along said southerly line 516.00 feet; thence North <br />63 degrees 38 minutes 48 seconds East 567.55 feet to the point <br />of beginning. <br />WHEREAS, the Developers hereby warrant and represent to the City as <br />inducement to the City's entering into this Agreement that Developer's <br />interest in the land area of the Development is fee owner. <br />WHEREAS, the City Council, by resolution adopted November i, 1988, has <br />granted preliminary approval to the Development, on the condition that the <br />Developers enter into this agreement to provide for the installation of <br />streets, utilities, landscaping and other improvements hereafter described <br />in the terms and conditions hereafter set forth. <br />
