ORDINANCE 8017 CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA AN ORDINANCE AMENDING THE 1979 MUNICIPAL CODE OF LAKE ELMO Section 1. Amendment. Sections 701.060, 701.070 and 701.090 of 1979 Municipal Code of Lake Elmo adopted October 16, 1979, and subsequently amended by Ordinance 8012 is hereby amended to read as follows: 701.060 A.3. The City recommends that a maintenance inspection be performed not less than annually by the owner or his agent. Such inspection should include, but is not limited to: 701.060 A.4. The septic tank shall be pumped to remove all accumulated septage whenever inspection of the septic tank discloses that the accumulated sludge in the bottom of the tank has reached a point twelve inches or less from the bottom of the outlet baffle device, or that the bottom of the floating scum layer is less than three inches above the bottom of the outlet baffle device; however, the time interval between maintenance pumping shall not exceed two years. 701.060 6.d. The owner shall be responsible to promptly initiate action to provide adequate expansion or replacement of any soil treatment system found to be inadequate as a result of (c) above. 701.060 9. RECORDS AND REPORTS . Licensed contractors shall maintain accurate records of pumping activity and shall report such data monthly to the Zoning Administrator on forms provided by him. 701.070 A.1. This ordinance shall apply and be in effect for the stated purposes within the City of Lake Elmo. 701.090 A.3. In the event of a violation of the septic tank pumping required in Section 701.060 A.4., the Zoning Administrator may, after ten day mailed notice to the record owner, order the pumping performed, and have the cost thereof plus 100%, placed as a special assessment against the property and to certify the same to the County Auditor for collection in the same manner as �( taxes and special assessments are certified and collected.
