ORDINANCE 8017 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />AN ORDINANCE AMENDING THE 1979 MUNICIPAL CODE OF LAKE ELMO <br />Section 1. Amendment. Sections 701.060, 701.070 and 701.090 of <br />1979 Municipal Code of Lake Elmo adopted October 16, 1979, and <br />subsequently amended by Ordinance 8012 is hereby amended to read <br />as follows: <br />701.060 A.3. The City recommends that a maintenance <br />inspection be performed not less than annually <br />by the owner or his agent. Such inspection <br />should include, but is not limited to: <br />701.060 A.4. The septic tank shall be pumped to remove all <br />accumulated septage whenever inspection of the <br />septic tank discloses that the accumulated <br />sludge in the bottom of the tank has reached <br />a point twelve inches or less from the bottom <br />of the outlet baffle device, or that the <br />bottom of the floating scum layer is less <br />than three inches above the bottom of the <br />outlet baffle device; however, the time <br />interval between maintenance pumping shall <br />not exceed two years. <br />701.060 6.d. The owner shall be responsible to promptly <br />initiate action to provide adequate expansion <br />or replacement of any soil treatment system <br />found to be inadequate as a result of (c) above. <br />701.060 9. RECORDS AND REPORTS . Licensed contractors shall <br />maintain accurate records of pumping activity <br />and shall report such data monthly to the Zoning <br />Administrator on forms provided by him. <br />701.070 A.1. This ordinance shall apply and be in effect for <br />the stated purposes within the City of Lake Elmo. <br />701.090 A.3. In the event of a violation of the septic tank <br />pumping required in Section 701.060 A.4., the <br />Zoning Administrator may, after ten day mailed <br />notice to the record owner, order the pumping <br />performed, and have the cost thereof plus 100%, <br />placed as a special assessment against the <br />property and to certify the same to the County <br />Auditor for collection in the same manner as <br />�( taxes and special assessments are certified <br />and collected. <br />
